CALL TO ORDER:

Jim Petrie, Treasurer, called the meeting to order at 3:10 p.m. All were present except Randy Mae and Frank Winter who were excused. A quorum was established.

REVIEW AGENDA:

APPROVAL OF PREVIOUS MINUTES DATED:

August 15, 2007, minutes were reviewed and accepted by consensus.

TREASURER’S REPORT: (Please see the Office for attached/enclosed as none were provided with these minutes)

Jim Petrie presented the treasurer’s report for the Water and Sewer Association (see attached). Water and Sewer completed the eleventh month of the fiscal year with no significant deviations from budget.

MANAGER’S REPORT: Steve Horsmon presented the Manager’s Report

General Office and Budget Updates:
  1. 2007-2008 Water and Sewer billing has been completed and meter readings are being recorded as payments are received. Annual usage report due to the Water Commissioner by end of December.
  2. New GVM maps need to be ordered this winter. We are working on a major update of the current map including a street cross-reference and clearer filing delineations. No advertising is planned to make space.
  3. Glacier Viewpoint completed and mailed out on 8/28/07.
  4. Mary has started a new process of forwarding membership cards with a welcome letter to new owners.
  5. Board member educational information is provided featuring articles on foreclosures and on using contractors for snow removal.

Water & Sewer Association

  1. New septic system at Filing 8, Lot 58 has been installed by Apex and is operational.
  2. Local Improvement District article to be published in the North Forty News this month. Met with the North Front Range Water Quality Assoc. on 09/7/07. Their review of the wastewater treatment application yielded only a few questions and they thought the proposal was a model for other communities.
  3. A large water main leak was reported at Mt. Massive and Mt. Sherman on 9/12/07. Gary and Jerry located the leak and repaired within 2 hours.
  4. El Diente project started this week. This will add a missing tap to one property and allow a contractor to deep bury another resident line.
  5. We are trying to help the remaining 35 acre property owners in the North Rim Rd. subdivision achieve withdrawal from the Association. Their accounts linger from year to year and they need to change their well permits.

OLD BUSINESS:

  1. Further discussion of funds transfer from budget account 001 to the budget account 002 "community system repair" and GVM legal counsel input. The manager stated that a Glacier View Resident presented new information concerning transferring funds from Management account 001 to Community system account 002. The informational document states: The fee cannot be used to support, in any way, systems that are not available or required for all members to use. The capital cost, operation and maintenance of each facility, such as pipes lines, truck and sewer plants are to be paid for by the user of the facilities and not from the general fund. The manager stated that this is an explanation document, not a recorded legal document. Because of the new information, G.V.M. Legal Counsel, Josh Zugish informed the manager that it will take longer than anticipated to examine documentation and render an opinion. Further discussion tabled until October Meeting.

NEW BUSINESS:

During the Road & Recreation Meeting Gary Ellerman proposed selling the old GMC septic pumping truck. The manager stated that in the event of an emergency a private septic contractor can be in Glacier View in an hour. The manager stated that the truck has not been used for three years. Jim Petrie moved to sell the GMC septic truck. Unanimous-motion passed.

Note: Public input given at the end of the Road & Recreation meeting however, input relates to the Water & Sewer Association.

A member voiced opinions and concern that the transferring of general funds to fund the wastewater treatment plant might not be in the best interest of the entire membership.

The member also asked the Boards, what criteria are used when calling an executive (or closed) meeting. The manager stated special meetings are called if they are categorized as statutory exceptions allowed by law. The manager stated that 98% of closed meetings are personnel related. It was noted that no motions are adopted in executive session. The member cautioned the Board against having closed session meetings unless they meet the proper guidelines for closed meeting.
