JOINT MEETING MINUTES
May 20, 2009

CALL TO ORDER:

Frank Winter – President, Water & Sewer, called the meeting to order at 3:00 p.m. All were present, except Linda Adams who had an excused absence, a quorum was established.

REVIEW MEETING MINUTES DATED: February 18, 2009:

On the subject of the Alpaca, Tom Willard reminded the Boards that before approving minutes of board discussions, it is important that all views are recorded accurately. When asked, Tom agreed the minutes do accurately reflect all voiced views. Tom Willard – Secretary, Water and Sewer, moved to accept minutes as written. Unanimous - motion passed.

TREASURERS REPORT:

Water and Sewer :

Jim Petrie –Treasurer, presented the treasurer’s report for the Water and Sewer Association (see attached). Water and Sewer completed the seventh month or 58% percent of the fiscal year with no significant deviations from the budget. It was explained that administrative expenses are a little high (76%) because the annual payment to the Greeley Water Court for 75 shares of Mountain and Plains Irrigation Company Water Rights, just posted.

Road and Recreation :

Mike McKay-Treasurer, presented the treasurer’s report for the Road and Recreation Association. (see attached) Road & Recreation completed the tenth month or 83% of the budget year. As planned, the road operating expenses continues to be a little high because of materials purchased earlier in the year. There are no significant deviations from the budget.

MANAGERS REPORT: Steve Horsmon, G.V.M. Manager, presented the manager’s report

General Office and Budget Updates:
  1. The 2nd quarter newsletter is complete and in the mail. Proposed budgets and all Annual Meeting announcements are included. We need the boards to review the agenda and discuss chairmanship for the meeting. Also, a color, noxious weed brochure produced by an Ecology Committee member will be stuffed into this newsletter.
  2. The seasonal roll-off dumpster arrived on May 15th and the new gates were installed on May 16th.
  3. The Larimer County Workforce Center summer internship program is still in process. If an intern match is made for our location, we will attend a luncheon to learn how the 8 week process works and how to fill out related paperwork. We applied for two positions.
  4. Dee and Mary have already started on the June billing process. Membership cards will be included with all bills this year as approved in an earlier board meeting. This will save about $400 in postage. Good idea Mary!
  5. Met with our insurance representative to review D&O and General Liability coverage. They analyzed our coverage with respect to an article included in your package. Results will be discussed later during New Business.
  6. Jerry Blanz has offered to sell his Maxey 7.5’ snow plow (used 5 times) for $3000. Maxey Truck will install for $1300 including new mount. The Dodge 2500 is the truck we would like to attach it to for additional plowing capacity. A new unit would cost $5,300 installed. The manager suggests the board consider approving the expense to buy and install the used plow from Jerry Blanz.
Road and Recreation Association
  1. New gate sign prototypes installed at gate 8. Slight modifications were made to improve visibility and the new design has been installed at gate 12. The Sign Shop has been released to finish all of the order.
  2. A lot of road damage (including courts) occurred during the last big snow removal effort. We are grading as fast as possible to address the damage. Progress is slower because of the number of courts which need repair.
  3. Riddle Lake and Batterson Lake are full and looking good. Crellin Lake is continuing to fill and is higher now than anytime last year. Flywater, Inc. finished stocking all 3 lakes on 5/19/09 and the engineering/habitat assessments were done. The findings will be presented to the board when they are complete and will plan to report the results at the Annual Meeting.
  4. The new slash pile at Gate 3 is getting record breaking business. We will need to expand it to the north before the end of the summer and push it into windrows more frequently.
Water & Sewer Association
  1. The wastewater treatment plant concrete work is complete for the control building. Framing lumber was delivered on 5/19/09. Framing will start 5/20/09. The 40,000 lb. contact tank was delivered and set on 5/8/09. Underground plumbing is in process between the building and tank and between the main tank and contact tank. Electrical bid packages were submitted to Larimer County Purchasing on 5/15/09. They must post this large bid in the newspaper and website and submit it to 7 contactors. An onsite meeting will be held during the week 5/25/09. Ed Schemm (Larimer County Health Dept.) informed me that the final State approval of the Discharge Permit may take until August. This would prevent us from “going live” until approval is done.
  2. Jerry and Lynn completed the final sewer line replacement on Big Horn Mtn. Ct. in the 3rd Filing. The line is now buried to 4-5’. We shouldn’t have anymore freezing problems with this line.
  3. We are working on the summer list of water and sewer projects that can be completed. No major deep bury projects are scheduled, however, we do want to complete the installation of a new manhole and emergency shut off valve at the 7th Filing storage tank as discussed in previous meetings.
Under General Office and Budget Updates Item F: The board agreed by consensus to purchase the Maxey 7.5’ snow plow for $3000 and have Maxey Truck install the plow on the Dodge truck for $1300.

OLD BUSINESS:

  1. Horse property Designation Status – Filing 11, Lot 1. At the Boards’ request and in order not to violate the 11th filing supplemental covenants, Kelly Fox and his attorney asked Larimer County to consider changing the Lot #. The County will not consider a request to change the legal description. Upon investigating the supplemental covenants that state which lots are horse properties the manager discovered that there are no listed horse properties in the 11th filing. At this point, the Board tabled further discussion until legal advice is obtained will discuss again at the August meeting.

    A well “change in use” is still a requirement which would permit watering of two horses. Since Kelly Fox has purchased part of the unimproved horse lot, Filing 10, Lot 60, there are horse watering rights available now that he has consolidated his lot with a portion of Filing 10, Lot 60. The owner of Filing 11, Lot 2 with whom Kelly split the unimproved horse lot has legally assigned to Kelly Fox his portion of the water rights associated with Filing 10, Lot 60. If the horse lot designation issue above is resolved, the Board will need to provide a “non-objection letter” to submit along with a permit application to the Colorado Div. of Water Resources. The Board has indicated they would do this since the result will still meet the intent of the original court decree.

NEW BUSINESS:

  1. Annual Meeting Agenda Format: The Annual Meeting Agenda was discussed and the Board agreed to the new format of invited guests speaking before the meeting is called to order.
  2. Community Barbeque - 5:00 pm, June 19, 2009: Board members agreed to pitch in $30.00/each. Mike McKay agreed to shop for supplies.
  3. Insurance Coverage Analysis – The manager met with the associations’ insurance agent. The manger asked several questions (taken from a Community Essentials article). With our current policy we are adequately insured in all applicable areas. There were questions concerning the Glacier Gals and their activities being insured under Glacier View Meadows liability policy. GVM’s policy will cover GVM legal costs associated with any claims. However, the individual members of Glacier Gals are not be covered under our liability policy when involved in activities not under the direction of the GVM boards. It was suggested that the Glacier Gals consider purchasing a small liability policy for their organization.

PUBLIC INPUT:

A resident voiced concern about pine beetle and preventive spraying. He stated that spraying is not recommended on a large scale for ecological reasons. Even though spraying should not contaminate the ground water it may be found in surface water. He also said that the Forest Service recommends that owners choose around 5 high-value trees to spray. He also suggested that all applicators have a commercial license.

There was also concern voiced about the speeding ATV’s being driven to the bus stop at Gate 1. The sheriff’s department can’t give speeding tickets on private roads but can issue reckless driving tickets. It was noted that Eiger Rd is a County Road and is subject to the same laws as any public road.
